PPK (Pracownicze Plany Kapitałowe – Employee Capital Plans) is a new voluntary savings scheme. This is another form of additional social security.

The introduction of PPK means that employers are obliged to offer the possibility of making savings as group investment while ensuring the payment of contributions, both by employers (1.5% of gross salary) and employees (2% of gross salary).

In connection with operating PPK, new administrative and information obligations have been imposed on the employer, such as:

  • signing an agreement for PPK management with a selected financial institution;
  • signing, on behalf and for the benefit of employees, agreements for PPK management;
  • timely calculation of basic and additional contributions;
  • archiving documentation related to PPK.

The Law Firm offers legal support related to the implementation and operation of PPK to both employers and financial institutions intending to offer and operate PPK.

  • advising the employer on the selection of a PPK managing entity to meet the requirements of the employer;
  • negotiations with the managing entity to enter into an agreement that duly safeguards the interests of the employer, potential negotiations with trade unions or other employee groups;

  • keeping the employers up-to-date on changes in the legal and tax environment;

  • support in the day-to-day administration of the scheme, in accordance with the Client’s expectations.

  • legal support in the process of creating life-cycle funds and sub-funds;
  • support in the preparation of PPK products through the preparation of document templates (e.g. PPK management agreements, agreements to operate PPK, declarations);
  • providing training and giving presentations for institutions operating PPK or intending to establish PPK;
  • assistance in registering a given entity which intends to operate PPK in the PPK register (preparing and filing the application together with all necessary documents, representation in proceedings before the authority admitting the product);
  • preparing or giving opinions on marketing materials concerning the offered PPK product;
  • assistance in the preparation and implementation of procedures/internal regulations for the operation of PPK;
  • assistance in the preparation of periodic evaluations of PPK and monitoring of the activities of the managing entity;
